Terms and Conditions of Use

Welcome to KS4PharmaNet (hereinafter referred to as "the Company", "we", "us", or "our"). KS4PharmaNet operates an online platform accessible via web and mobile applications for the sale and delivery of pharmaceutical products, healthcare goods, and related services across India.

These Terms and Conditions ("Terms") govern your access to and use of the KS4PharmaNet platform, including all purchases, subscriptions, and interactions. These Terms are a legally binding contract between you ("User", "Customer", "you") and KS4PharmaNet.

Applicable Laws

These Terms are governed by and construed in accordance with the following Indian legislation, as amended from time to time:

• The Drugs and Cosmetics Act, 1940 & Rules, 1945
• The Pharmacy Act, 1948
• The Information Technology Act, 2000 and IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021
• The Consumer Protection Act, 2019 and Consumer Protection (E-Commerce) Rules, 2020
• The Personal Data Protection Bill / Digital Personal Data Protection Act, 2023
• The Indian Contract Act, 1872
• The Legal Metrology Act, 2009 and Legal Metrology (Packaged Commodities) Rules, 2011
• The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954
• Foreign Exchange Management Act, 1999 (FEMA) where applicable

By registering on or using the KS4PharmaNet platform, you represent and warrant that:

• You are at least 18 years of age or have obtained valid parental/guardian consent.
• You are legally capable of entering into a binding contract under the Indian Contract Act, 1872.
• You are not a person barred from receiving services under applicable Indian law.
• The personal information you provide is accurate, current, and complete.
• You will use the platform solely for lawful personal or household purposes and not for resale or commercial distribution.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion if eligibility criteria are not met.

3.1 Account Creation

To place orders on the platform, you must create an account by providing accurate and complete information including your name, mobile number, email address, and delivery address. You agree to keep this information updated.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to notify us immediately of any unauthorized use of your account.
• KS4PharmaNet shall not be liable for losses arising from unauthorized access due to your failure to protect your credentials.

3.3 Account Termination

We reserve the right to suspend or terminate your account without prior notice if you violate these Terms or engage in fraudulent, abusive, or unlawful behavior.

📌 Pursuant to the Drugs and Cosmetics Act, 1940 and Rules 65 & 65-A of the Drugs and Cosmetics Rules, 1945, prescription medicines may only be dispensed against a valid prescription from a Registered Medical Practitioner (RMP).

4.1 Prescription Requirement

• All Schedule H, Schedule H1, Schedule X, and other prescription-only drugs (Rx) require a valid prescription before dispatch.
• Users must upload a clear, legible image or scan of the original prescription signed by a licensed RMP.
• The prescription must contain: patient name, date, doctor's name, qualification, registration number, and clinic/hospital stamp.
• Prescriptions more than 6 months old will not be accepted unless otherwise specified.

4.2 Prescription Verification

• KS4PharmaNet employs trained pharmacists registered under the Pharmacy Act, 1948 to verify all prescriptions.
• We reserve the right to decline fulfillment of any order where the prescription appears forged, tampered, or invalid.
• Any misrepresentation of prescription details may result in legal action under applicable law.

4.3 Partial/Refusal of Dispensing

Our pharmacists retain professional discretion to partially fill or refuse to dispense any prescription in the interest of patient safety, as per the Code of Ethics of the Pharmacy Council of India.

The following products shall not be sold or delivered through the KS4PharmaNet platform:

• Narcotic drugs and psychotropic substances regulated under the NDPS Act, 1985.
• Schedule X drugs except where explicitly permitted and with valid documentation.
• Spurious, adulterated, or misbranded drugs as defined under the Drugs and Cosmetics Act, 1940.
• Products making false or misleading therapeutic claims under the Drugs and Magic Remedies Act, 1954.
• Any medicines banned by the Central Drugs Standard Control Organisation (CDSCO).
• Over-the-counter products purchased on behalf of third parties for resale without appropriate authorization.

6.1 Pricing

• All prices listed on the platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
• Prices are governed by the Maximum Retail Price (MRP) as printed on the product packaging, in compliance with the Legal Metrology (Packaged Commodities) Rules, 2011.
• KS4PharmaNet may offer discounts on MRP subject to applicable regulatory guidelines. No product shall be sold above MRP.

6.2 Taxes

• Goods and Services Tax (GST) is applied as per the rates notified by the GST Council of India.
• Invoices issued by KS4PharmaNet shall comply with GST Invoice requirements under the CGST Rules, 2017.

6.3 Payment Methods

We accept the following payment modes:

• UPI (Unified Payments Interface)
• Net Banking
• Credit/Debit Cards (Visa, MasterCard, RuPay)
• Prepaid Wallets (subject to RBI guidelines)
• Cash on Delivery (COD) — available at select pincodes and subject to order value limits

6.4 Payment Security

All online payment transactions are processed through RBI-regulated and PCI-DSS compliant payment gateways. KS4PharmaNet does not store your card details on its servers.

7.1 Delivery Area

KS4PharmaNet currently delivers to select pincodes across India. Serviceable areas are subject to change without prior notice.

7.2 Delivery Timelines

• Standard delivery: within 24 to 48 hours (subject to prescription verification and product availability).
• Express delivery: within 2 to 4 hours in select cities (additional charges may apply).
• Delivery timelines are estimates and not guaranteed; delays may occur due to logistics, natural events, or regulatory hold.

7.3 Delivery Conditions

• Cold-chain products (requiring refrigeration) will be shipped with appropriate packaging; however, KS4PharmaNet does not guarantee temperature maintenance beyond its control.
• The risk of loss and title for products pass to you upon delivery to the specified address.
• If delivery cannot be completed due to incorrect address, absence of recipient, or restricted access, you may be charged a re-delivery fee.

7.4 Force Majeure

KS4PharmaNet shall not be liable for delays caused by acts of God, natural disasters, strikes, government restrictions, epidemics, or other events beyond reasonable control.

📌 Under the Consumer Protection (E-Commerce) Rules, 2020, KS4PharmaNet is required to provide a clear return and refund policy. The following terms apply.

8.1 Non-Returnable Items

Due to health, safety, and regulatory requirements, the following cannot be returned:

• Medicines (prescription or over-the-counter) once delivered.
• Products with broken seals or opened packaging.
• Temperature-sensitive items (injections, biologicals, vaccines).
• Baby food, nutritional supplements, and personal care items once opened.

8.2 Eligible Returns

Returns are accepted within 7 days of delivery in the following circumstances:

• Wrong product delivered.
• Product found to be defective, expired, or damaged at the time of delivery.
• Product does not match description as listed on the platform.

8.3 Refund Process

• Approved refunds are processed within 7 to 10 business days to the original payment source.
• Refunds for COD orders will be credited to your registered bank account or digital wallet.
• GST refunds (if applicable) will follow the applicable GST law provisions.

8.4 Order Cancellation

• Orders may be cancelled before dispatch by contacting customer support.
• Once dispatched, orders cannot be cancelled.
• KS4PharmaNet reserves the right to cancel orders due to stock unavailability, prescription rejection, delivery constraints, or suspected fraud.

Your privacy is important to us. KS4PharmaNet collects, processes, and stores personal data in compliance with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.

9.1 Data Collected

• Identity data: name, age, gender, government ID (where required).
• Health data: prescription details, medical history (voluntarily provided).
• Contact data: phone number, email, delivery address.
• Transaction data: payment records, order history.
• Usage data: browsing behavior, device identifiers, IP address.

9.2 Use of Data

• To fulfill and manage your orders and provide customer support.
• To comply with legal obligations including drug regulations.
• To send transactional communications (order confirmations, delivery updates).
• To personalize your experience and improve our services.
• Marketing communications only with your explicit consent.

9.3 Data Sharing

We do not sell your personal data. We may share data with:

• Registered pharmacists and healthcare professionals for prescription processing.
• Logistics and delivery partners for order fulfillment.
• Payment processors and banking partners.
• Government or regulatory authorities as required by law.

9.4 Your Rights

All content on the KS4PharmaNet platform — including but not limited to logos, trademarks, text, graphics, software, and databases — is the exclusive property of KS4PharmaNet or its licensors and is protected under:

• The Copyright Act, 1957
• The Trade Marks Act, 1999
• The Information Technology Act, 2000

Unauthorized reproduction, distribution, modification, or commercial use of any content from this platform is strictly prohibited and may attract civil and criminal liability under applicable law.

11.1 Medical Disclaimer

11.2 Platform Disclaimer

• KS4PharmaNet acts as a facilitator between the customer and the licensed pharmacy. We are not responsible for the therapeutic efficacy of any drug.
• We make no warranties regarding the completeness, accuracy, or reliability of product information from manufacturers.

11.3 Limitation of Liability

To the maximum extent permitted under Indian law, KS4PharmaNet shall not be liable for:

• Any indirect, incidental, or consequential damages arising from product use.
• Loss of data, profits, goodwill, or business interruption.
• Adverse reactions to medicines arising from user non-compliance with prescription or directions.

Our maximum aggregate liability shall in no event exceed the transaction value of the relevant order.

In accordance with the Consumer Protection Act, 2019 and the IT (Intermediary Guidelines) Rules, 2021, KS4PharmaNet has appointed a Grievance Officer:

Grievances shall be acknowledged within 48 hours and resolved within 30 days of receipt, in compliance with applicable law.

For drug-related complaints, you may also approach the State Drug Control Authority or CDSCO.

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

13.2 Dispute Resolution

• In the first instance, users are encouraged to reach out to our Grievance Officer.
• Disputes not resolved amicably may be referred to Arbitration under the Arbitration and Conciliation Act, 1996, with a sole arbitrator appointed by KS4PharmaNet.
• The seat of arbitration shall be [City], India, and proceedings shall be conducted in English.
• Notwithstanding arbitration, either party may approach the consumer courts under the Consumer Protection Act, 2019.

13.3 Jurisdiction

Subject to the above, the courts at Lucknow, Uttar Pradesh shall have exclusive jurisdiction over any disputes arising out of these Terms.

KS4PharmaNet reserves the right to modify, update, or replace these Terms at any time. Amendments shall be effective upon publication on the platform. Your continued use of the platform after such changes constitutes acceptance of the revised Terms. We will endeavor to notify registered users of material changes via email or in-app notification.

15.1 Entire Agreement

These Terms, along with our Privacy Policy and any applicable policies referenced herein, constitute the entire agreement between you and KS4PharmaNet.

15.2 Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force.

15.3 Waiver

Failure by KS4PharmaNet to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign our rights.

15.5 Grievance under POSH

KS4PharmaNet is committed to a safe and respectful environment. Any concerns related to workplace conduct during delivery interactions may be reported to our POSH Committee as per the Sexual Harassment of Women at Workplace Act, 2013.

BY USING THE KS4PHARMANET PLATFORM, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
